My name is Lance Perdue. I am an Oregon divorce lawyer and mediator with over 27 years experience. HERE IS HOW MEDIATION WORKS: I SIT DOWN WITH THE TWO OF YOU AROUND A TABLE IN AN INFORMAL SETTING. I GO OVER ALL OF THE DECISIONS THAT THE TWO OF YOU MUST MAKE IN A DIVORCE, INCLUDING CHILD CUSTODY AND VISITATION, CHILD SUPPORT, SPOUSAL SUPPORT, CHILD TAX EXEMPTIONS, PROPERTY DIVISION, DEBT DIVISION, HEALTH AND LIFE INSURANCE, AND RETIREMENT DIVISION. I GIVE THE TWO OF YOU MANY OPTIONS OF WHAT YOU MIGHT DO, IF YOU CANNOT DECIDE WHAT TO DO ABOUT SOME ISSUE. IF YOU HAVE A DISAGREEMENT ABOUT SOME QUESTION, I MEDIATE THOSE QUESTIONS FOR YOU AND YOUR SPOUSE, PREPARE ALL PAPERWORK FOR THE DIVORCE, REVIEW IT WITH THE TWO OF YOU, AND MAKE WHATEVER CHANGES THE TWO OF YOU NEED. Mediation reduces the overall stress of an ended marriage. The two of you will work out your divorce or separation, through the help of the neutral mediator, and not through "hired guns" costing each of you thousands, or even tens of thousands of dollars.
When I mediate your divorce, I do not take sides. I am the neutral and calm party who sits in the middle. My only goal is to help the two of you reach a lasting agreement that will be recognized by the Oregon courts.
After you have reached an agreement with my assistance, I write up all the paperwork and submit everything to the judge for signing. You will not have to go to the courthouse for a trial, or any kind of hearing before a judge. You (and your children, if you have any) will be spared the stress and humiliation of a nasty court battle.
WHAT DOES MEDIATION COST?
Each divorce, of course, is different. However, in almost every case, a mediated divorce costs only a fraction of what the traditional, contested divorce cost. In the traditional divorce, especially if there are children, or when support is in disagreement, each party will pay their respective lawyer several thousands of dollars before it is all over. Often tens of thousands. The initial retainer for a traditional divorce in the Portland area is often upwards of $3,500.00, for each person. That's just the amount that you pay up-front.
The cost for my mediation service is a fraction of that. Most often the total cost for my mediation service is far less than the cost each of you would pay your own lawyer, just for him or her to get started on your case. To get started on a divorce mediation, each party only pays $750, about $2,000 less than each of you would pay your separate lawyers just to get started. It's your money. You can spend it on two separate lawyers, or you can mediate with an experienced lawyer, and save thousands of dollars.
